Rental Agreement & Waiver

This Rental Agreement (“Agreement”) is between Hoop Monterey LLC (“Provider”) (DBA Hoop Monterey) and the individual or entity booking the Hoop Trailer (“Customer”). By booking and paying for a Hoop Trailer rental, the Customer agrees to the following terms:

  1. Booking & Payment
    1. Full payment is required at the time of booking to confirm and reserve your event date and time slot.
    2. We accept credit card payments, and the transaction fee is already included in the listed price.
    3. Bookings are not confirmed until full payment is received.
  2. Service Provided
    1. Provider will deliver, set up, and later pick up the Hoop Trailer at the agreed event location.
    2. Rental includes:
      1. 4 full-size arcade basketball hoops
      2. LED party lights
      3. Sound system
      4. Low-noise gas generator*

      *A standard electrical outlet within 50 ft is preferred. If unavailable, a low-noise generator will be provided at no extra cost.

    3. NOTE: A staff member will be present during setup to ensure proper installation and to provide a brief orientation on trailer operation to the host. Staff presence during the event itself is not guaranteed and will depend on availability.
  3. Customer Responsibilities
    1. Customer must ensure there is a clear, level space (approx. 25 ft) for trailer setup and safe access for delivery.*
    2. Customer is responsible for supervising all guests using the Hoop Trailer during the event.
    3. Customer agrees to leave the Hoop Trailer in the same condition as it was set up.

    *If the Customer is unable to meet the required space or access requirements at the time of setup, they will still be charged the full rental amount.

  4. Delivery & Zone-Based Travel Charges
    1. Free Delivery. We offer complimentary delivery to select nearby areas around our Salinas base. Availability varies by event location and schedule.
    2. Automatic Calculation & Customer Review. Zone-based delivery charges are automatically applied based on the event address entered during booking. The Customer must review and confirm the delivery fee on the booking summary before submitting payment.
    3. Address Accuracy & Changes. If the Customer enters an incorrect address, changes the address after booking, or if mapping indicates a different zone than initially calculated, the delivery fee may be adjusted. Provider will notify the Customer of any adjustment. Unpaid additional delivery fees may result in cancellation or delay of delivery; overpayments will be refunded or credited.
  5. Safety & Liability
  6. The Hoop Trailer is designed for safe entertainment; however, all use is at the Customer’s and guests’ own risk. Provider is not liable for any injuries, damages, or losses resulting from use of the trailer. Customer agrees to indemnify and hold Provider harmless from any claims arising from the event.

  7. Cancellations & Refunds
    1. 7+ days before event – full refund of deposit.
    2. 2–7 days before event – deposit will be credited towards a future booking (valid for 1 year).
    3. Less than 48 hours – deposit is non-refundable.

    In case of extreme weather, unsafe conditions, or unforeseen circumstances, Provider may reschedule or cancel with a full refund.

  8. Damage & Loss
  9. Customer is responsible for any damage, theft, or vandalism to the Hoop Trailer during the rental period caused by negligence or misuse. Repair or replacement costs will be billed to the Customer.

  10. Media Release
    1. By participating in a Hoop Monterey LLC event, the Customer and all guests grant permission to Hoop Monterey LLC to capture, use, and share photographs, video recordings, and other media taken during the event for promotional and marketing purposes, including use on social media, websites, and printed materials.
    2. Participants will not be compensated for the use of this content.
    3. If any attendee wishes not to be photographed or recorded, it is the Customer’s responsibility to notify Hoop Monterey LLC in advance of the event.
  11. Force Majeure
  12. Provider is not responsible for cancellations or delays caused by events beyond its reasonable control (e.g., severe weather, accidents, emergencies).

  13. Governing Law
  14. This Agreement shall be governed and enforced in accordance with the laws of the State of California.

  15. Waiver & Release of Liability
    1. Participation in the Hoop Trailer activities involves inherent risks of injury or property damage.
    2. The Customer and all guests voluntarily assume all risks associated with the use of the Hoop Trailer.
    3. The Customer, on behalf of themselves and their guests, releases, waives, discharges, and covenants not to sue Hoop Monterey LLC, its owners, employees, or contractors for any and all liability, claims, demands, or causes of action arising from injury, damage, or loss resulting from the use of the Hoop Trailer.
    4. The Customer agrees to indemnify and hold harmless Hoop Monterey LLC from any claims brought by participants or third parties arising out of the rental or use of the Hoop Trailer.
    5. This waiver applies to all participants, whether minors or adults. By signing this Agreement, the Customer represents that they have the authority to accept this waiver on behalf of all participants.

  17. By booking the Hoop Trailer, the Customer confirms they have read and agree to these Terms & Conditions.
